			<content:encoded><![CDATA[<p>It has been reported that the UK&#8217;s financial services regulator, the Financial Services Authority, has banned a mortgage broker. The ban was imposed because the broker allegedly failed to prevent mortgage fraud. <span id="more-1741"></span></p>
<p>The London based mortgage broker was accused of negligence in failing to prevent fraud and incompetence. The FSA said that Kevin Byrne, who was working at Forest Financial, did not have the competence of integrity to stop mortgage fraudsters from targeting the business.</p>
<p>According to the FSA mortgage referrals were accepted by Byrne from third parties. However, he simply accepted these referrals without bothering to verify or check the information on them.</p>
<p>This resulted in him submitting seven applications that contained false and misleading information and in the case of one application that was submitted the person on the application did not even exist.</p>
<p>The FSA has been cracking down on mortgage fraud over the past couple of years, and in particular since its mortgage review last year it has been clamping down on this type of activity. Already a number of mortgage related firms and brokers have been fined or banned by the FSA for mortgage related fraud.</p>
<p>In the case of Forest Financial, Mr Byrne was not only found to have been incompetent and lacking in diligence with regards to the applications that he submitted, but also found to have certified a number of supporting documents that were sent in with the applications without carrying out any of the necessary checks.</p>
<blockquote><p>An official from the FSA stated: &#8220;This made him an easy target for the introducer to obtain mortgage advances from lenders on a fraudulent basis, which could have been prevented if Forest Financial had put in place basic financial crime checks.&#8221;</p></blockquote>

			<content:encoded><![CDATA[<p>Over recent months there have been a number of signs of recovery in the property market, with increasing property prices, a growth in property transactions, easing up of the mortgage markets, and increased interest from would be buyers.<span id="more-1735"></span></p>
<p>These signs of recovery have been described as green shoots, and an increase in consumer confidence when it comes to the property market in the UK appears to be another of these green shoots that suggest the property market is on the up again.</p>
<p>One recent report has shown how confidence amongst consumers seems to be returning to the property market. The data came from the Paragon Mortgages‘ Financial Adviser Confidence Tracker FACT. The report showed that the majority of mortgage brokers were expecting to more business over the course of this year than they did last year, with 58 percent of brokers stating that they were expecting to be far busier over the coming months.</p>
<p>Many said that they thought the increase in consumer confidence was down to the continued rock bottom base interest rate, a return of more affordable mortgage loans to the market, and an increase in properties.</p>
<p>John Heron, Paragon Mortgages’ managing director, commented on the figures from the report, stating that things in the mortgage and property markets had been showing signs of improvement over recent months.</p>
<blockquote><p>He stated: &#8220;As house prices seem to have turned the corner, buyer confidence has increased and we have seen a slight tick up in mortgage approvals in recent months.&#8221; He did go on to state, however, that the market had a very long way to go yet in order to get back to normal. He stated that borrowing rates were still &#8220;low compared to the historical average and the market is nowhere near back to normal yet.&#8221;</p></blockquote>

			<content:encoded><![CDATA[<p>A recent report has suggested that lenders may be pushing their more expensive mortgage deals onto consumers, with deals such as short term fixes, which are being pushed by lenders, proving to be costly for consumers. Many lenders are said to be focussing on pushing deals where rates are fixed for two years or less, and which tend to be the most expensive for consumers.<span id="more-1622"></span></p>
<p>Many borrowers prefer to opt for a shorter term fix, as this means that they do not have to be locked into a particular interest rate for a long period of time. However, the downside to this is that those with short term fixed rate deals have to remortgage on a more regular basis, and with the fees and costs involved in this the costs can really add up and make this a very expensive option.</p>
<p>The average two year fixed rate deal costs around £1000 in arrangement fees, and this makes it unviable for those with smaller mortgages of less than around £100,000. Figures have shown that over the past nine months, with interest rates remaining at an all time low of just 0.5 percent the number of new mortgage products on the market have been increasing and many of the new products that have been coming onto the market have been two year fixed rate deals.</p>
<blockquote><p>Michael White, a mortgage broker, stated: &#8216;Fixed rates have come down, but they&#8217;ve hardly been slashed. They needed to be lowered because they are not as competitive as equivalent tracker deals. If borrowers believe interest rates are set to stay low, then a two-year tracker at under 4% looks a lot more attractive than a two-year fixed rate at more than 5%.&#8217;</p></blockquote>

			<content:encoded><![CDATA[<p>The banking industry has suffered a series of knock backs over the past couple of years, and as a result of a number of factors many consumers have lost confidence in banks and building societies, which have come under fire for a variety of things. <span id="more-1561"></span></p>
<p>However, one building society has recently been honoured with a national award, which was awarded to the building society in November.</p>
<p>The award was made earlier this month at the Mortgage Finance Gazette awards ceremony in London.</p>
<p>The award that was made to the building was the Best Regional Building Society award, and at a time when many banks and building societies are facing fierce criticism the award has been welcomed by the Carlisle based building society.</p>
<p>The Cumberland was found to have offered the most consistently competitive mortgage rates over the course of the year.</p>
<p>The Cumberland also went on to win another award at the ceremony, and scooped the Community Services award, which goes to small and medium sized lenders.</p>
<p>A spokesperson from the building society said that the Cumberland was very proud to have received the prestigious awards and added that the lender would continue to try and provide competitive rates on mortgages.</p>
<p>He also said that the building society is a traditional one, and that it aims to put the interests of its customers at heard.</p>
<blockquote><p>He said: &#8220;We are delighted to be named the UK’s Best Regional Building Society. We aim to provide consistently competitive mortgages and it is great to see this recognised at a national level. Being a traditional building society we have put the interests of our members first ever since we were established, and we continue to do so now. Although this has been called boring and old fashioned in the past, our traditional approach to lending has allowed us to build on our financial strength and keep providing good value mortgage and savings products throughout the current economic difficulties.&#8221;</p></blockquote>

			<content:encoded><![CDATA[<p>Over recent years mortgage fraud has become a big problem in the UK as well as in other countries and the UK&#8217;s financial regulator, the Financial Services Authority, has been clamping down on this sort of activity through taking various measures including hefty fines and bans for those industry officials that are found to be involved in mortgage related fraud. <span id="more-1353"></span></p>
<p>The regulator has recently banned one mortgage broker and handed down a hefty fine for engaging in mortgage related fraud.</p>
<p>The London broker, Grace Nmadibechi Ada Ukala, has been banned from operating by the FSA and has been fined an enormous £70,000 for her part in the submission of misleading and false mortgage applications. </p>
<p>The broker was the director of Goldsparkle Consulting Services Limited and had been approved by the FSA. According to reports she submitted five mortgage applications for herself, but put in dishonest information about income and employment.</p>
<p>The broker was also found to have hidden information about the firm&#8217;s finances from HM Revenue and Customs. The fine could have been for much more, but as she opted to settle early it was reduced. </p>
<p>An FSA official said: &#8220;This fine, which would have been £100,000 had Ukala not settled early, is aimed at deterring approved persons from getting involved in mortgage fraud. Her earnings, as stated in the mortgage applications, were considerably higher than the income she declared to HMRC. By knowingly submitting false and misleading mortgage applications, Ukala acted in a totally unacceptable fashion.&#8221;</p>
<p>She added: &#8220;Our work on mortgage fraud continues as a priority in our campaign against financial crime. We have banned more than 60 mortgage brokers over the last three years and we will continue to ban such people to reinforce the message that knowingly giving false and misleading information is dishonest and poses a serious risk to prospective lenders. We will continue to ban individuals who demonstrate a lack of integrity.&#8221; </p>

			<content:encoded><![CDATA[<p>The UK&#8217;s financial regulator, the Financial Services Authority, has recently taken action against a mortgage broker that was said to be involved in fraudulent activity. <span id="more-1143"></span></p>
<p>The regulator has both fined and banned the broker after he was allegedly found to have been involved in the submission of false mortgage applications. The broker at the centre of the action was <strong>Abiola Agbalaya</strong>, and officials from the FSA said that the action taken against the broker was a deterrent against others getting involved in mortgage fraud, which has become more prevalent since the onset of the global credit crunch since when mortgage finance has become increasingly difficult to come by.</p>
<p>In the past two years the FSA has apparently banned over thirty brokers in a bid to try and reduce mortgage fraud. It is said that in the latest case the broker managed to obtain several mortgages having submit applications that overstated both his income and the profits that his company, Herald Finance Ltd, was making. A mortgage consultant working at Herald, Grace Olatunji, was also banned for the submission of applications that contained false income details.</p>
<p>The FSA has already made it clear over the past year or two that harsh punishment and any necessary action will be taken against mortgage industry professionals that are found to be involved in this sort of fraud. The regulator has been striving to crack down on mortgage fraud levels recently, and as a result those that are found to be involved are given serious punishments, including hefty fines and bans from operating in the industry.</p>
<blockquote><p>One official from the FSA said: &#8220;Perpetrators of fraud will increasingly find themselves facing bans and significant fines as we continue our work in this area.&#8221;</p></blockquote>

			<content:encoded><![CDATA[<p>A mortgage broker from the UK has been fined a massive £30,000 by authorities after being accused of giving advice that put consumers at risk during the ongoing global credit crunch and financial crisis. William John Evans, along with a fellow director from Abbey Mortgages, were fined by the Financial Services Authority earlier this month. The FSA is exercising an ongoing crackdown on unscrupulous lenders and brokers given the current financial climate and the state of the housing and mortgage markets.<span id="more-391"></span></p>
<p>Having analysed a sample of around 113 cases between January of 2006 and April of 2008 officials from the UK&#8217;s financial regulator found that Abbey Mortgages Ltd had not met the standard required. Mr Evans was found to have carried out inadequate checks with regards to whether the customers were earning the income that they claimed to earn, which led to customers taking on mortgages that they could not afford repayments on.</p>
<p>The standard FSA fine is £50,000 but the directors were unable to afford this, and instead opted for the high cost review instead. The two directors avoided a fine of £42,000 each by agreeing to pay the fine as quickly as possible.</p>
<blockquote><p>Mr Evans stated: &#8220;The cases they were concerned about we have to pay for an independent company to do a full review to make sure there was no detriment to our clients. This couldn&#8217;t have come at a worse time with the market in the state it is. We&#8217;re not short of enquiries, we&#8217;re just short of mortgages for them.&#8221;</p></blockquote>
<p>An <a title="FSA" href="http://www.fsa.gov.uk">FSA</a> official said: &#8220;Obtaining and clearly recording the right information from customers is not just about process. It is an important step in preventing financial crime and giving customers the right advice and treating them fairly. This is always important but is especially important in difficult economic times.&#8221;</p>

			<content:encoded><![CDATA[<p>Over recent months the level of concern over falsified applications put forward to mortgage lenders from brokers has increased in light of the global credit crunch that has swept across the UK from the United States, where it was sparked in the sub-prime sector of the mortgage market. The effect of the credit crunch have increased concerns over brokers falsifying employment and income information on behalf of customers that either do not earn enough realistically to raise a sufficient mortgage or do not have proof of income.<span id="more-15"></span></p>
<p>As a result of this the UK&#8217;s financial regulator, the <a href="http://www.fsa.gov.uk">Financial Services Authority</a>, has been clamping down on lenders and brokers that falsify information, as it puts the borrower in danger of quickly defaulting on mortgage repayments due to being unable to afford repayments on their realistic income rather than based on their fabricated one, and this could further raise the level of repossessions, which has already been increasing due to affordability problems amongst homeowners.</p>
<p>Two brokers from Abbaci Associates in Ilford have now been banned by the FSA for submitting falsified applications on behalf of customers. One of the brokers even claimed that one customer worked for him, submitting false payslips – the customers had never actually worked for the broker at all. The two brokers that have been banned by the FSA are Amjad Malik and Tahir Mahmood.</p>
<p>One FSA official stated: “The actions of the these two partners posed a risk to lenders, and banning them supports the FSA’s financial crime objective as well as our consumer protection and market confidence objectives. It is part of a wider effort to tackle mortgage fraud, which includes working alongside other authorities such as the police, and acting on information received from lenders and whistleblowers.”</p>
